Financial institutions increasingly find themselves facing enhanced risk due to changes in the regulatory environment where there is an emphasis on rooting out any potentially discriminatory conduct and unfair, deceptive, or abusive acts or practices. In this environment, we find that regulators tend to take novel and aggressive approaches in investigating transactions in favor of imposing liability. Using the experience we have gleaned representing financial institutions during examinations, enforcement actions, and litigation, we will share our unique insights into recent hot topics in fair lending and UDAAP.
